Our mission is to create meaningful connections between artists, collectors and the broader community through exhibitions, events, online marketplaces and creative opportunities. These Terms of Use explain the rules that help make that possible.

By accessing or using our website, submitting artwork, purchasing artwork or merchandise, registering for events or otherwise interacting with The Art Market, you agree to these terms of use. If you do not agree with these Terms, please do not use our website or services.

We believe legal documents should be transparent. While these Terms of Use are intended to protect both you and The Art Market, they are also meant to clearly explain what you can expect from us and what we ask from our community in return.

1. Acceptance of Terms

By accessing or using The Art Market website, participating in our programs or events, submitting artwork, purchasing artwork or merchandise, commissioning artwork, or otherwise interacting with our services, you agree to be bound by these Terms of Use and our Privacy Policy, as well as any additional agreements that may apply to specific services, events, or programs.

If you are using this website or our services on behalf of an organization or business, you represent that you have the authority to accept these Terms on that organization's behalf.

If you do not agree to these Terms of Use, please discontinue use of the website and our services.

Your continued use of the website following any updates to these Terms constitutes acceptance of the revised Terms.

2. About The Art Market

The Art Market is a primarily online platform dedicated to supporting artists and connecting them with collectors, businesses, and the broader community through curated artwork, exhibitions, commissions, educational resources, and creative opportunities. From time to time, we may also host or participate in in-person exhibitions, markets, events, and other community programs.

Our website may provide access to a variety of services and opportunities, including but not limited to:

  • Artist applications and artwork submissions

  • Online artwork and merchandise sales

  • Commission inquiry services

  • Featured artist opportunities

  • Educational content and resources

  • Virtual and in-person exhibitions or events

Certain services may be governed by additional agreements, policies, or guidelines. For example, artists submitting work for consideration may also be required to accept a separate Artist Agreement, exhibition guidelines, licensing terms, or commission policies. Where applicable, those additional agreements supplement these Terms of Use. If there is a conflict between these Terms and a service-specific agreement, the service-specific agreement will govern that particular service.

3. Eligibility & User Responsibilities

By using The Art Market website or services, you represent that you are at least 18 years of age or are using the website under the supervision of a parent or legal guardian. By accessing our website, you agree to use it only for lawful purposes and in accordance with these Terms of Use.

You agree to:

  • Provide accurate, current, and complete information when submitting forms, applications, purchases, or other requests.

  • Use the website in a respectful manner that does not interfere with the experience of other users.

4. Artist Submissions

The Art Market welcomes artwork submissions from artists seeking consideration for exhibitions, sales opportunities, commissions, publications, and other programs offered through our platform. Submission of artwork does not guarantee acceptance, representation, exhibition, publication, sale, or participation in any program.

Artists are responsible for ensuring that all information submitted - including artwork images, descriptions, pricing, dimensions, and other materials - is accurate and current. By submitting artwork, you represent that you own or otherwise control the necessary rights to the submitted content and have the authority to grant any permissions required for The Art Market to evaluate and administer your submission.

Artists selected for certain opportunities may be required to enter into additional agreements, including but not limited to an Artist Agreement, exhibition guidelines, licensing terms, commission agreements, or other program-specific policies. These agreements govern the applicable program in addition to these Terms of Use.

The Art Market reserves the right to accept, decline, remove, or discontinue consideration of any submission at any time if we determine that it does not meet our curatorial standards, submission requirements, legal obligations, or community guidelines.

Submission materials may be retained for administrative, archival, legal, or historical purposes in accordance with our Privacy Policy and any applicable program agreements.

5. Intellectual Property

The Art Market respects the intellectual property rights of artists, creators, collectors, and other contributors. Unless otherwise indicated, all content on The Art Market website- including but not limited to text, graphics, logos, branding, website design, layouts, photographs, videos, written materials, and other original content- is owned by or licensed to The Art Market and is protected by applicable intellectual property laws.

Artists retain ownership of the copyrights and other intellectual property rights in their original artwork unless they expressly agree otherwise in writing. Submission, acceptance, display, or sale of artwork through The Art Market does not transfer ownership of the artwork or its underlying intellectual property rights to The Art Market.

By submitting artwork for consideration, artists represent and warrant that they own or otherwise control the rights necessary to submit the artwork and authorize The Art Market to review, display, promote, and administer the submission process.

For artwork accepted and made available through The Art Market, the artist grants The Art Market an exclusive, worldwide license for the duration of the applicable Artist Agreement or participation period to market, display, promote, sell, and facilitate approved commercial opportunities associated with the accepted artwork. This exclusive license may include, where applicable, the exclusive right to administer the sale of original artwork, giclée prints, licensing opportunities, merchandise, commissions, and other approved commercial uses associated with the accepted artwork.

During the applicable participation period, artists agree not to independently sell, license, reproduce for commercial purposes, authorize merchandise production, or otherwise commercially exploit accepted artwork outside of The Art Market without prior written approval from The Art Market, unless otherwise permitted under a separate written agreement.

Where an artist elects to participate in The Art Market's giclée print program, the artist authorizes The Art Market to create, market, and sell reproductions of the accepted artwork through approved production and fulfillment processes. The Art Market may determine print specifications, production standards, pricing, and sales channels in accordance with its program guidelines. Artists will receive compensation according to the applicable revenue-sharing terms or other written agreements governing the giclée print program.

Where an artist elects to participate in licensing, merchandise, or other commercial opportunities, The Art Market may negotiate, administer, and facilitate those opportunities on the artist's behalf in accordance with the applicable program terms. Artists will receive compensation according to the applicable revenue-sharing terms, licensing agreements, merchandise agreements, or other written agreements governing the specific opportunity.

The Art Market may use submitted artwork images, artist statements, biographical information, and related materials to operate the platform, promote artists and their work, advertise exhibitions or programs, communicate with collectors, and otherwise support the mission and activities of The Art Market.

Except as expressly permitted through these Terms of Use, an applicable Artist Agreement, or with prior written permission from the applicable rights holder, users may not reproduce, distribute, modify, publish, create derivative works from, download for commercial purposes, or exploit any artwork or content displayed on The Art Market website.

If you believe that content appearing on The Art Market website infringes your intellectual property rights, please contact us with relevant information so that we may review the matter and take appropriate action.

6. Purchases, Payments & Marketplace Transactions

The Art Market provides a platform for collectors, customers, and supporters to discover and purchase original artwork, giclée prints, merchandise, and other creative offerings from participating artists. By purchasing through The Art Market, you acknowledge that you are entering into a transaction facilitated through The Art Market's platform and agree to the terms outlined below.

Artwork Availability & Pricing

All artwork, prints, merchandise, and other offerings listed through The Art Market are subject to availability. We reserve the right to modify, update, remove, or discontinue any listing, product, pricing, availability, or offering at any time.

The Art Market makes reasonable efforts to ensure that artwork descriptions, images, dimensions, pricing, and other listing information are accurate. However, variations may occur, including but not limited to differences in color, texture, materials, or appearance due to photography, display settings, or the nature of handmade artwork.

Prices displayed on The Art Market website are listed in U.S. dollars unless otherwise indicated. While we strive to maintain accurate pricing information, errors may occasionally occur. If an error affects your order, The Art Market reserves the right to contact you with updated information and provide appropriate options for resolution.

Payments & Transactions

Payments are processed through third-party payment providers and platforms selected by The Art Market. By submitting payment information, you authorize The Art Market and its payment providers to process the transaction necessary to complete your purchase.

Payment information is handled in accordance with our Privacy Policy and the policies of applicable payment processors. The Art Market does not store complete payment card information.

Purchasers are responsible for providing accurate billing, shipping, and contact information. The Art Market is not responsible for delays, failed delivery, or other issues resulting from inaccurate or incomplete information provided by the purchaser.

Original Artwork, Prints & Merchandise

Purchases of original artwork, giclée prints, merchandise, and other creative products may be subject to additional terms regarding production, fulfillment, customization, shipping, returns, or exchanges. Any applicable terms will be provided at the time of purchase or through related policies.

For giclée prints and other reproduced artwork, production methods, sizing, materials, and fulfillment processes may vary depending on the selected artwork and applicable program guidelines. The Art Market makes reasonable efforts to maintain quality and consistency while recognizing that fine art reproductions may contain natural variations.

Commissions & Custom Artwork

Requests for commissioned artwork, custom pieces, or artist collaborations submitted through The Art Market do not guarantee acceptance, completion, pricing, availability, or a final transaction.

Commission arrangements may require additional written agreements between the purchaser, artist, and/or The Art Market outlining scope, pricing, timelines, payment terms, revisions, delivery requirements, and other applicable details.

Shipping, Delivery & Artwork Accessibility

Purchasers are responsible for ensuring that purchased artwork can be safely delivered, received, and accommodated at the intended delivery location.

Before completing a purchase, purchasers should carefully consider the artwork's dimensions, weight, materials, installation requirements, and any location-specific limitations. This includes confirming that the artwork can reasonably fit through all necessary access points, including but not limited to doorways, hallways, elevators, stairways, loading areas, entrances, and installation spaces.

For oversized, fragile, or specialty artwork, The Art Market may require specialized shipping, courier services, handling arrangements, delivery appointments, or installation support. Additional fees or requirements may apply depending on the artwork and delivery location.

Purchasers are responsible for providing complete and accurate delivery information and notifying The Art Market of any known restrictions or requirements prior to shipment or delivery. This may include building policies, elevator reservations, loading restrictions, access limitations, security requirements, or installation considerations.

The Art Market may coordinate professional shipping, courier, handling, or installation services when appropriate. While The Art Market and/or selected service providers may maintain applicable insurance coverage during transit, purchasers remain responsible for ensuring that the artwork can be accepted, accessed, and accommodated at the delivery location.

The Art Market is not responsible for delays, additional delivery costs, failed delivery attempts, return shipping charges, or other issues resulting from inaccurate delivery information, undisclosed access limitations, or the purchaser's failure to confirm that the artwork is suitable for the intended location.

By completing a purchase through The Art Market, purchasers acknowledge their responsibility to review artwork details, understand delivery requirements, and provide accurate information necessary to complete the transaction.

7. Website Content & Availability

The Art Market strives to provide accurate, reliable, and up-to-date information through our website. However, we do not guarantee that all website content will always be complete, current, or free from errors.

Artwork listings, artist information, product descriptions, pricing, availability, event details, and other website content may be updated, corrected, modified, or removed at any time without prior notice.

The Art Market may occasionally experience interruptions, delays, maintenance periods, or technical issues that affect website availability. While we make reasonable efforts to maintain a reliable online experience, we do not guarantee that the website or any portion of our services will always be available, uninterrupted, or error-free.

The Art Market makes reasonable efforts to provide accurate information, facilitate transactions, support artists and collectors, and provide reliable services. However, we do not guarantee the outcome of any transaction, artist interaction, commission inquiry, delivery arrangement, or other experience facilitated through our platform.

To the fullest extent permitted by law, The Art Market's total liability arising out of or relating to these Terms of Use, the website, or any services provided through The Art Market will not exceed the amount paid by you to The Art Market for the specific transaction or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless The Art Market and its owners, directors, officers, employees, contractors, affiliates, partners, and service providers from and against any claims, damages, liabilities, losses, expenses, and costs, including reasonable attorneys' fees, arising out of or related to:

You agree that any legal action or proceeding arising out of or related to these Terms of Use shall be brought exclusively in the state or federal courts located in California, and you consent to the jurisdiction and venue of those courts.

Before initiating any formal legal proceeding, The Art Market encourages users to contact us directly so that we may attempt to resolve any concerns or disputes in good faith.

The Art Market will not be responsible for delays, interruptions, failures, or inability to perform obligations caused by circumstances beyond our reasonable control.

Nothing in this section limits any payment obligations already completed or any rights or obligations that cannot be limited under applicable law.
