Terms and Conditions

  1. Artist Representations and Authenticity

  • You affirm that all artwork submitted and sold is your original work or that you have the full rights to sell it

  • You confirm that no submitted work infringes on any copyrights, trademarks, or intellectual property rights of others

  • Artists are responsible for providing a Certificate of Authenticity for each original artwork or limited edition sold through The Art Market

  • The certificate must accurately state the title of the artwork, artist’s name, date of creation, medium, dimensions and any relevant edition number

  • Artist will supply a listing photograph that aligns with the vision of The Art Market or subject to a photographer recommended by the Market


  1. Pricing and Commission

  • Artists will submit a base rate, or suggested selling price, for each artwork during the listing process

  • The Art Market, in consultation with its in house assessor and curatorial team, reserves the right to adjust the final retail pricing based on market standard, comparable works and curatorial considerations

  • Pricing adjustments may include increases or decreases from the artists submitted base rate

  • Artists will be informed of the final listing price before the artwork is published for sale

  • If the artists strongly disagrees with the final assessed price, they may withdraw the artwork from listing prior to publication without penalty. This withdrawal must be requested within {X} business days of receiving the final pricing notifications

  • The Art Market **retains a commission of {X}% of the final selling price or **applies a listing fee of {X}$ if applicable 


  1. Shipping, Fulfillment and Delivery Responsibilities 

  • Artists are fully responsible for packaging and shipping their sold artwork to customers

  • Artists must ship sold items within the timeline agreed upon at the time of artist submission and acceptance into The Art Market

  • Artists must provide a valid tracking number once the item has been shipped

  • Failure to ship artworks within the agreed upon timeframe may result in fines, late fees or penalties assessed by The Art Market

  • Fines or fees may continue to accrue until the artwork is successfully delivered to the buyer

  • Late shipments or failure to fulfill orders may result in removal from the Marketplace


  1. Returns and Refunds

  • In the case of lost, damaged or undelivered shipments, artists must cooperate to resolve issues with buyers

  • Artists are responsible for refunding or replacing orders if necessary, unless otherwise negotiated


  1. Intellectual Property

  • Artists retain full copyright to their artwork

  • Artists grant The Art Market a non-exclusive license to use images of the artwork for marketing, promotional and platform purposes


  1. Termination

  • Either party may terminate the agreement with written notice

  • Upon termination, The Art Market will remove the artist’s work from the platform within {X} days


  1. Liability

  • The Art Market is not liable for damages, losses or disputes arising from the sale, shipment or delivery of artworks. Our role is to provide the platform for transactions between artists and buyers


  1. Changes to Terms

  • Pasadena Arts Marketplace reserves the right to modify these Terms & Conditions. Notice will be given to artists via email or platform update notifications
